Trendsetter Tours Liability Waiver

I, the undersigned hereby acknowledge and understand that during my trip with Trendsetter Tours I may be exposed to a variety of hazards and risks, foreseen or unforeseen, which are inherent including traveling in a vehicle/boat, recreation exercise, climbing stairs and related activities. These inherent risks include, but are not limited to, the dangers of serious personal injury, death and property damage or loss of property (“Injuries and Damages”) resulting from, but not limited to: (i) physical exercise and exertion; (ii) physical contact with vehicles/boat, buildings, individuals and water hazards; (iii) falling or tripping due to water hazards, uneven surfaces or debris; (iv) falling from heights, including falling off or out of Vehicles and boats (v) other hazards associated with travel in vehicles and boats, (vi) wild animal attacks, snake bites, diseases found in tropical areas, (vii) attacks from bandits, robberies or pirating.

I further acknowledge and understand that the risk of these Injuries and Damages cannot be eliminated without destroying the unique character of the experience and use of the vehicles and boats as well as the areas of Guyana we will be visiting. I fully understand that Trendsetter Tours Operators have not tried to contradict, hide or minimize my understanding of these risks. I know that Injuries and Damages can occur by natural causes or activities of other persons, other users, staff of Trendsetter Tours or other third parties, either as a result of negligence or because of other reasons. I understand the risks of such Injuries and Damages involved in use of vehicles and boats while on any part of the trip and I am aware that I may have to exercise extra care for myself and others around me in the event of such hazards.

I further understand that there may not be medical personnel or medical facilities or expertise necessary to deal with Injuries and Damages to which I may be exposed. I am responsible for my own medical health including any medical emergencies that may occur while on the tour. I also accept full responsibility to inform Trendsetter Tours of medical or food allergies and even after informing them they are not responsible if I come in contact with something that causes an allergic reaction, either accidently or due to negligence.

I further understand that on rare occasions an emergency requiring medical treatment can develop. I hereby consent to receive medical treatment that may be deemed advisable in the event of injury, accident, or illness during use of vehicles, boats or other causes during the tour. I agree to pay for any medical, dental, surgical, or other hospital care, or diagnosis rendered to me.

It is understood that I am required to designate emergency contact(s) and that efforts shall be made to contact my designated emergency contact(s) before rendering treatment, but that any of the above treatment will not be withheld if the designated emergency contact(s) cannot be reached.

In consideration for my acceptance as a willing participant of Trendsetter Tours, and the services and amenities provided by Trendsetter Tours in connection with such use, I CONFIRM MY UNDERSTANDING OF THE FOLLOWING: To the fullest extent allowed by law, I agree to WAIVE AND DISCHARGE CLAIMS AGAINST, RELEASE FROM LIABILITY, INDEMNIFY AND HOLD HARMLESS Trendsetter Tours Operators, its subsidiaries and affiliates and their respective  officers, directors, stockholders, managers, members, partners, agents and employees (collectively, “Released Parties”) from and against ANY AND ALL LIABILITY on account of, or in any way resulting from, my death or personal injury relating to my participation in the tour arrangement, even if caused by NEGLIGENCE of the Released Parties; Such negligence could involve (a) negligent operation and supervision of the vehicles and boats or activity, (b) negligent maintenance or operation of the equipment, vehicles and boats in general, (c) negligent manufacture of or use of equipment to be used in the vehicle and boats including the vehicle and boats themselves, and (d) the negligent provision of emergency response services, (e) or any illness caused by food provided on the tour, (f) this could also include attacks or robberies from people in the areas we visit.

I understand that the assumption of risk and release is binding upon my heirs, executors, administrators, and assigners. This Waiver and Release is intended to be as broad and inclusive as is permitted by law. If any provision or any part of any provision of this Waiver and Release is held to be invalid or legally unenforceable for any reason, the remainder of this Waiver and Release shall not be affected thereby and shall remain valid and fully enforceable.

I understand Trendsetter Tours’ top priority is safety and as an Inbound Tour Operators, they work with third-party transport and accommodation providers. In the event that a contracted third party fails to deliver the agreed-upon services, Trendsetter Tours will make every effort to arrange an alternative to cover that portion of the tour as fullest to my understanding.

Alcohol and Illegal Drug/Firearm: I understand Client(s) are permitted to bring limited alcoholic beverages on Trendsetter Tours trips. Prohibited Drugs and illegal Firearms are not allowed on trips period. Anyone found with illegal drugs/firearm will be reported to the nearest police station. Attempts to buy drugs while on Trendsetter Tours trip will result in me being reported to the police or they will abandon me in the middle of nowhere if they discover I attempted to buy and transport illegal drugs/firearm. I understand and confirm that alcohol consumption shall be at my own discretion, risk, and liability. I will always maintain an appropriate measure of sobriety. I understand that Trendsetter Tours have the right to remove me if I become drunk and misbehave or have the capacity to cause harm to myself or other persons on the tour. This may also involve use of law enforcement and being abandoned at any given location the Operators/Tour Guides deems necessary if I am a threat to them and others. If I am removed because of my unbearable actions, there will be no refund or reimbursement by the Tour Operators. I hereby acknowledge all risk involved with the consumption of alcohol and unconditionally hold Trendsetter Tours of no responsibility for my actions.

For the sake of clarity, and to the fullest extent allowed by law, I agree to WAIVE AND DISCHARGE CLAIMS AGAINST, RELEASE FROM LIABILITY, INDEMNIFY AND HOLD HARMLESS Trendsetter Tours Operators its subsidiaries and affiliates and their respective officers, directors, stockholders, managers, members, partners, agents and employees (collectively, “Released Parties”) from and against ANY AND ALL LIABILITY on account of, or in any way resulting from, my death or personal injury relating to alcohol impairment while on the trip. The Tour Operators have the authority to terminate a tour or remove individuals with inappropriate behaviour and forfeit all deposits and fees for Client(s) who violated their terms. including but not limited to Extreme Intoxication, Public Urination in an inappropriate manner, Littering, Indecent Languages/Actions/Exposure. I agree to be respectful of Trendsetter Tours Operators/Tour Guides, their affiliates etc.  as well as the people of the communities and villages we will pass through or visit throughout the beautiful country of Guyana.

                                  MISSALANOUS INFORMATION

• Client(s) are responsible to secure all Personal Belongings and Valuables at all times. We are not responsible for any loss due to negligent by Client(s).
• Client(s) are responsible for their underage children at all time. Your kid(s) behaviour must not affect or disturb other persons that are taking part of same tour. Ensure your kids do not write/draw/colour on any vehicles/boat’s seats or in any accommodations. You will have to pay for any damages or cleaning.
• Trendsetter Tours Operators are not responsible for any mishaps/tragedies/fatalities during swimming in any water be it Creeks, Trenches, Rivers, Pools, Waterfalls etc. Client(s) are swimming at their own risk.
• Client(s) are required to wear life jackets on all moving Boats.
• Client(s) participating in any outdoor cooking will be doing so at their own risk.
• Some overnight tours required checking into accommodation(s), we will not be responsible for Client(s) who leave those premises without the knowledge of Trendsetter Tours or leave unknowingly during any part of the tour.
•  Client(s) are responsible for any costs (including repair, replacement and cleaning fees) incurred by the Tour Operators or their Affiliates to property damage, destruction or theft caused by client(s). You agree to immediately report any pre-existing damage to the Tour Operators, Tour Guides or staff(s) of the Accommodation, Transportation Service/Boat service/facility as soon as possible upon discovery.
• Client(s) are to disclose if they will be taking a License firearm when booking and this must be a private group tour. This is due to the fact that other Client(s) may not be comfortable with the presence of firearm and some might be against hunting/animal cruelty.

Bad Weather or Other Natural Occurrences: In the case where Trendsetter Tours is prevented from completing your tour because of bad weather, low water or any other unforeseen event that are beyond our control we will be responsible for getting you back to pick up point. There will be no refunds if the tour was well underway or on the returning side when any event prevents the Tour Operators from completing the tour. In cases where an event(s) prevents the tour from commencing at all you will be granted 100% REFUND.

Medical Information: The Tour Operators reserves the right to deny any Client(s) permission to travel or participate in any aspect of a Tour at any time. If the Tour Operators determines that your physical or mental condition renders you unfit to travel or you represent a danger to yourself or others, you will be denied access to participate. Pregnancy must be disclosed to Trendsetter Tours at the time of booking. The Tour Operators may refuse to carry women who are over 24 weeks pregnant or refuse to carry anyone with certain medical conditions if reasonable accommodation or alternatives cannot be arranged. Trendsetter Tours may organise trips that involve visiting remote or undeveloped regions, where medical care may not be easily accessible and medical facilities may not meet the standards of those found in your home country. Trendsetter Tours makes no representations and gives no warranties in relation to the availability or standard of medical facilities in those regions.

There are no toilet facilities on board Buses or Boats but we do regular stops at places and will do our best to accommodate you when nature calls.

This WAIVER is publicly displayed on our website AND IT IS UNDERSTOOD THAT YOU READ AND AGREE to its terms and conditions with or without a signature before booking with Trendsetter Tours.
